Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Answerman Management LLC d/b/a BlastLister ("BlastLister," "we," "us," or "our"), a Florida limited liability company. These Terms govern your access to and use of the BlastLister website, application, and all related services (collectively, the "Service").

By creating an account, clicking "I agree," purchasing a subscription, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent that you meet these requirements. The Service is intended for business and professional use by resellers, not for personal, family, or household purposes.

2. Account Registration

You must register for an account to access most features of the Service. You agree to:

• Provide accurate, complete, and current information during registration.
• Keep your login credentials confidential and not share them with any third party.
• Notify us immediately at support@blastlister.com if you become aware of any unauthorized use of your account.
• Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently or for unauthorized purposes.

3. Free Trial

We offer a 30-day free trial with full access to the Service. At the end of the trial period, your account will automatically convert to the paid plan you selected unless you cancel before the trial expires. You will not be charged during the trial period. We reserve the right to modify or discontinue the free trial offer at any time.

4. Subscriptions and Billing

Plans

BlastLister offers monthly and annual subscription plans. Plan pricing is displayed on our website and may be updated from time to time. Continued use of the Service after a price change constitutes acceptance of the new pricing.

Billing

Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your plan). Payments are processed by Stripe. You authorize us to charge your payment method on a recurring basis until you cancel. All amounts are in US dollars.

Cancellation

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of your current billing period. You will retain access to the Service through the end of the period you have paid for. We do not provide prorated refunds for partial billing periods.

Refunds

All fees are non-refundable except as required by applicable law or as expressly stated in these Terms. If you believe you have been charged in error, contact us at support@blastlister.com within 14 days of the charge and we will review your request.

Failed payments

If a payment fails, we will attempt to collect payment using alternate billing dates. If payment cannot be collected after reasonable attempts, we may suspend or terminate your account.

5. Third-Party Marketplaces and Integrations

The Service allows you to connect to and publish listings on third-party platforms including eBay, Poshmark, Depop, Vinted, Mercari, Grailed, Whatnot, Facebook Marketplace, and Etsy (each, a "Marketplace"). You acknowledge and agree that:

• BlastLister is not affiliated with, endorsed by, or sponsored by any Marketplace unless explicitly stated.
• Your use of each Marketplace is governed solely by your agreement with that Marketplace. You are responsible for complying with each Marketplace's terms of service, listing policies, fee structures, and applicable laws.
• Marketplaces may change their APIs, technical requirements, listing rules, and policies at any time. Such changes may affect or disrupt the Service or specific integrations.
• BlastLister does not guarantee that any listing, import, sync, or other action initiated through the Service will be successfully completed on any Marketplace.
• You are solely responsible for the accuracy, legality, and appropriateness of all listings you publish through the Service.
• By connecting a Marketplace account, you represent that you have the authority to grant BlastLister access to that account for the purpose of posting and managing listings on your behalf.

6. AI Features

The Service includes AI-powered listing generation features that use third-party AI models to suggest titles, descriptions, and price points. You acknowledge that:

• AI-generated content is a suggestion only. You are responsible for reviewing, editing, and approving all content before it is published.
• BlastLister does not warrant that AI-generated content will be accurate, complete, or suitable for any particular purpose or Marketplace.
• You retain ownership of the listing content you create. By using the AI features, you grant us a limited license to process your listing data solely to provide the AI service.

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or Marketplace policy.
• List counterfeit, stolen, prohibited, or illegal items on any Marketplace.
• Spam, harass, or deceive buyers on any Marketplace.
• Attempt to circumvent the Service's rate limiting, security measures, or access controls.
• Reverse engineer, decompile, or create derivative works of the Service.
• Use the Service in a manner that could damage, disable, overburden, or impair our systems or those of any Marketplace.
• Use automated bots or scripts to access the Service in a manner not expressly permitted by these Terms.
• Resell or sublicense access to the Service to third parties without our written permission.

8. Intellectual Property

The Service, including its software, design, text, graphics, logos, and other content, is owned by Answerman Management LLC d/b/a BlastLister and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal business purposes in accordance with these Terms.

You retain ownership of all listing content, photos, and data you submit to the Service. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and display that content solely to provide the Service.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT ANY LISTING WILL BE SUCCESSFULLY PUBLISHED TO ANY MARKETPLACE OR THAT YOUR MARKETPLACE ACCOUNTS WILL REMAIN ACTIVE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BLASTLISTER, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM OR (B) $100 USD.

11. Indemnification

You agree to defend, indemnify, and hold harmless BlastLister and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any Marketplace's terms of service; or (d) any listing content you create or publish through the Service.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered in the State of Florida, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction. You waive any right to participate in a class-action lawsuit or class-wide arbitration.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice, effective immediately. Upon termination, your right to use the Service will cease. Sections that by their nature should survive termination (including Sections 7–12) will survive.

You may terminate your account at any time by canceling your subscription and emailing support@blastlister.com to request account deletion.

14. Changes to These Terms

We may modify these Terms at any time. When we do, we will update the "Last updated" date and, for material changes, notify you by email or by a prominent notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
